A Captain Cook man will face fines for promoting his kayak rental business at Kealakekua Bay Historical Park.
The state Board of Land and Natural Resources on Friday authorized a civil penalty of $3,253, including an administrative fee, against Alexander Aquino for promoting a commercial activity in a state park without a permit.
Aquino had a special use permit but that only authorizes kayaks and other vessels to transit the bay.
It does not allow for commercial activity at the park, according to the state Department of Land and Natural Resources.
The Division of State Parks enacted a moratorium in January 2013 on use of vessels within the bay except for guide tours granted permits.
Aquino was arrested Nov. 21, 2013, at Kealakekua Bay Historic Park during an undercover operation, according to DLNR.
Nathan Kolii, of Captain Cook, was also arrested and charged for the same violation.
Criminal cases are pending.
